Please read these Terms of Use ("Terms") carefully before using the DriftBreath mobile application ("App") operated by DriftBreath ("we," "our," or "us").

By downloading or using the App, you agree to be bound by these Terms.

1. Use of the App

DriftBreath is a wellness application that provides guided breathing exercises through visual and haptic feedback. The App is intended for general wellness purposes only.

1.1 Eligibility

You must be at least 13 years old to use DriftBreath. By using the App, you represent that you meet this requirement.

1.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

2. Health Disclaimer

IMPORTANT: DriftBreath is NOT a medical application.

• The App is designed for general wellness and relaxation purposes only.
• The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
• The breathing exercises provided are not a substitute for professional medical advice, diagnosis, or treatment.
• If you have any health conditions, including but not limited to respiratory issues, cardiovascular conditions, anxiety disorders, or sleep disorders, consult your healthcare provider before using breathing exercises.
• If you experience dizziness, discomfort, or any adverse effects, stop using the App immediately and seek medical attention if necessary.
• Always follow the advice of your healthcare provider over any suggestions in this App.

3. Subscriptions and Payments

3.1 Free and Premium Features

DriftBreath offers both free features and premium features through DriftBreath Pro, available via a paid subscription.

3.2 Billing

• All subscriptions are billed through Apple's App Store.
• Prices are displayed in the App before purchase and may vary by region.
• Payment is charged to your Apple ID account at confirmation of purchase.

3.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.

3.4 Free Trials

• If a free trial is offered, it will be clearly stated in the App.
• Unused portions of a free trial will be forfeited if you purchase a subscription before the trial ends.
• After the trial period, your subscription will automatically begin unless you cancel before the trial ends.

3.5 Refunds

• Refund requests are handled by Apple according to their refund policies.
• We cannot process refunds directly. Please contact Apple Support for refund requests.

4. Intellectual Property

All content in the App, including but not limited to design, graphics, text, and software, is the property of DriftBreath and is protected by copyright and other intellectual property laws.

5. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Reproduce, distribute, or create derivative works from the App

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Effective Date" at the top of these Terms. Your continued use of the App after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DriftBreath operates, without regard to conflict of law principles.
